Terms and Conditions

Definitions and Interpretation

The term “Official Deed Poll Service” or “us” or “we” or “our” refers to the owner of the business.

The term “you” refers to the user or viewer of our website or literature and anyone who makes contact with us by telephone,
e-mail or post.

The term “website” refers to www.officialdps.co.uk.

The term “application” refers to any electronic or written forms that are to be or have been completed to implement an order for goods or services that we provide.

The term “order” refers to an instruction from you to prepare or provide you with any of our goods or services.

The term “contract” refers to the agreement you make by accepting these terms and conditions.

Agreement

These terms and conditions, together with our privacy policy, govern Official Deed Poll Service’s relationship with you.

This agreement may change at any time and it is therefore advisable to make a copy of this agreement and keep it for your records as we cannot guarantee that this version of the agreement will be available at all times in the future.

By applying for or requesting any of our goods or services, by visiting our website or by contacting us in any way you are agreeing to comply with and be fully bound by this agreement and all of the conditions herein.

Variations and Amendments

We reserve the right to revise and amend these terms and conditions at any time without prior notice or warning.

These terms and conditions are currently available in English only.

Our Fees

The fees stated on our website are correct and can be viewed at anytime by visiting www.officialdps.co.uk/feesandservices or by sending an e-mail to contact@officialdps.co.uk.

Payment

Full payment of fees must be made before any goods or services are supplied. Payments can be made via PayPal with your credit or debit card. Payments can also be made directly to us by cheque, postal order, bank transfer or via cash at the bank. We charge the same fee regardless of how payment is made, but the company with which you make your payment may charge you a fee for doing so, for which we are not liable.

Cancellation

You cannot cancel your order if:

  • goods have already been made to your specification
  • services have begun, by agreement with the you, before the end of the 7 day cooling-off period

In accordance with The Distance Selling Regulations 2000, as our services will usually begin within 7 days and because the goods we prepare are done so to your specifications, your right to cancel your order or application ends once your order or application has been received and processed by us.

Orders and applications are usually processed the day that they are received, but this can vary depending on the means of submission and your chosen services.

The time by which an application will be processed depends upon the services you have chosen.

Non Fast-Track Applications

This service would not normally begin until after the 7 day cooling-off period, but could begin sooner.

You lose the right to cancel the contract once the application has been processed by us or seven days have passed, whichever happens soonest.

Fast-Track Applications

This service will begin the day your order has been received (if received on a working day) or the next working day.

You lose the right to cancel the contract once the application has been processed by us or once one working day has passed, whichever happens soonest.

If you wish to cancel an order, you must inform us, by e-mail - of your decision to cancel.

Force majeure

We will not be held liable for any events or circumstances beyond our control which prevents us fulfilling our full obligations to you.

Examples of events or circumstances can include, but is not limited to, war, strike, riot, crime, acts of terrorism and acts of God (e.g. flooding and earthquakes).

Electronic and mechanical failures, or failure by Royal Mail, are also events or circumstances for which we cannot be held liable.

Our Goods and Services

We provide goods and services in relation to Change of Name Deeds

Goods:

  • CHANGE OF NAME DEED FOR AN ADULT:

A Change of Name Deed for an adult is intended to be used - by anyone who is a British Citizen and full-time resident of the United Kingdom, and is aged 16 or older - to change their legal name on all documents and instruments as they so wish, within the United Kingdom only.

  • CHANGE OF NAME DEED FOR A CHILD:

A Change of Name Deed for a child - who is currently a British Citizen and full-time resident of the United Kingdom, and is aged 15 years or younger - is intended to be used by any person who has parental responsibility for the child, to change the child’s legal name on all documents and instruments as they so wish, within the United Kingdom only.

  • CERTIFIED COPIES OF AN ADULT’S DEED - FIRST COPY:

We can prepare copies of your Change of Name Deed and certify that these are true copies of the original that have not been altered in any way.

If you are ordering this service with your Change of Name Deed, the copies and any additional copies can only be prepared once you have fully executed and returned your original Change of Name Deed to us.

If you already have a fully executed Change of Name Deed, then this must be sent to us before we can prepare any copies or additional copies.

An adult’s executed Change of Name Deed can only be received by post and will not be accepted if sent by any other medium.

  • CERTIFIED COPIES OF AN ADULT’S DEED - ADDITIONAL COPIES:

We can prepare copies of your Change of Name Deed and certify that these are true copies of the original that have not been altered in any way. We can only provide additional copies once this has been done.

Additional copies can only be provided in addition to a First Copy and cannot be provided on their own, except when you deed has been archived.

If you are ordering this service with your Change of Name Deed, additional copies can only be prepared once you have fully executed and returned your original Change of Name Deed to us and we have prepared the first certified copy.

If you already have a fully executed Change of Name Deed, then this must be sent to us before we can prepare any copies or additional copies.

An adult’s executed Change of Name Deed can only be received by post and will not be accepted if sent by any other medium.

  • CERTIFIED COPIES OF A CHILD’S DEED - FIRST COPY:

We can prepare copies of your child’s Change of Name Deed and certify that these are true copies of the original that have not been altered in any way.

If you are ordering this service with your child’s Change of Name Deed, the copies and any additional copies can only be prepared once you have fully executed and returned your child’s original Change of Name Deed to us.

If you already have a fully executed a Change of Name Deed for your child, then this must be sent to us before we can prepare any copies or additional copies.

A child’s executed Change of Name Deed can only be received by post and will not be accepted if sent by any other medium.

  • CERTIFIED COPIES OF A CHILD’S DEED - ADDITIONAL COPIES:

We can prepare copies of your child’s Change of Name Deed and certify that these are true copies of the original that have not been altered in any way. We can only provide additional copies once this has been done.

Additional copies can only be provided in addition to a First Copy and cannot be provided on their own, except when your child’s deed has been archived.

If you are ordering this service with your child’s Change of Name Deed, additional copies can only be prepared once you have fully executed and returned your child’s original Change of Name Deed to us and we have prepared the first certified copy.

If you already have a fully executed Change of Name Deed for your child, then this must be sent to us before we can prepare any copies or additional copies.

A child’s executed Change of Name Deed can only be received by post and will not be accepted if sent by any other medium.

Services:

  • ARCHIVING OF AN ADULT’S CHANGE OF NAME DEED:

When you have fully executed your Change of Name Deed, you can return the document to us so that we can create a certified copy of the Deed and archive it.

Archived Deeds are placed on file, allowing you to request Certified Copies at any time without having to return your original Deed to us again. Also, if you lose your original Deed, and it has been archived, you can apply to receive certified copies for a fee of £4 per copy or a new original can be provided for free. A new original will be provided free of charge once, any further requests for a new original will be chargeable.

If you are ordering this service with your Change of Name Deed, the archived copy can only be prepared once you have fully executed and returned your original Change of Name Deed to us.

If you already have a fully executed Change of Name Deed, then this must be sent to us before we can prepare the archived copy.

An adult’s executed Change of Name Deeds can only be received by post and will not be accepted if sent by any other medium.

  • ARCHIVING OF A CHILD’S CHANGE OF NAME DEED:

When you have fully executed your child’s Change of Name Deed, you can return the document to us so that we can create a certified copy of the Deed and archive it along with a copy of the Letter of Parental Responsibility.

Archived Deeds are placed on file, allowing you to request certified copies at any time without having to return your child’s original Deed to us again. Also, if you or your child loses your child’s original Deed, and it has been archived, you can apply to receive certified copies for a fee of £5 per copy or a new original can be provided for free. A new original will be provided free of charge once, any further requests for a new original will be chargeable.

If you are ordering this service with your child’s Change of Name Deed, the archived copy can only be prepared once you have fully executed and returned your child’s original Change of Name Deed to us.

If you already have a fully executed Change of Name Deed for your child, then this must be sent to us before we can prepare the archived copy.

A child’s executed Change of Name Deeds can only be received by post and will not be accepted if sent by any other medium.

Fast-Track Service

  • FAST-TRACK SERVICE

Fast-Tracked applications will be processed the day that they are received, if this is by 4.30pm on a working day.

Your deed poll will be prepared and sent to you on the same day that your application is processed.

Applications received after 4.30pm on a working day, at weekends, or on a bank holiday, will be processed and prepared the next working day.

Delivery Services

  • STANDARD DELIVERY SERVICE

Delivery:
Once your documents have been prepared, they will be sent to you by Royal Mail’s First Class Post delivery service, with a delivery guidance of 2-3 working days.

No guaranteed delivery time is offered with this service option, the times stated are for guidance only.

  • STANDARD +PLUS DELIVERY:

Delivery:
Once your documents have been prepared, they will be sent to you by Royal Mail’s First Class Recorded (Signed For) Post delivery service, with a delivery guidance of 2-3 working days.

No guaranteed delivery time is offered with this service option, the times stated are for guidance only.

  • SPECIAL DELIVERY:

Delivery:
Once your documents have been prepared, they will be sent to you by Royal Mail’s Special Delivery Next Day service.

Delivery is guaranteed by 1pm the next working day, if the above conditions are met.

Improper use of our goods and services

All goods and services are provided to be used for their intended purposes - stated by us either in these terms and conditions, via our Website, in our e-mails or in any of our literature - only.

We shall not be held liable if any goods or services are used or have been attempted to be used - by any third-party - for anything other than their intended use.

It is your full responsibility to inform everyone who you have dealings with that you have changed your name.

If you have a criminal record then you must inform your local constabulary and - if you have one - your probation officer.

If you - at any time in the future - apply for any form of credit, you must make it clear - to the person whom you’re applying for credit from - that you have changed your name and you must also provide your previous name.

Waiver

Although every reasonable effort has been taken to ensure the accuracy, timeliness, performance, completeness or suitability of the information and materials available on our Website, in our literature or given over the telephone, neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on our Website, in our literature or given over the telephone for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Copyright

All written information provided by us either via our Website, in our e-mails or in any of our literature belongs to us must be used solely for their intended purpose and must not be copied or reproduced in any way without our prior written consent.

The content of the Change of Name Deeds that we prepare are also owned by us and must not be copied or reproduced in any way without our prior written consent.

Liability

Our liability extends only to the cost of any goods or services purchased and we cannot be held responsible for any subsequent loss, damage, injury or for any fraudulent activity that may be caused from the use of our goods, services, e-mail addresses, Website, telephone or fax numbers. Our liability beyond this is fully omitted to the fullest extent that is permitted by English law.

Governing Law and Jurisdiction

These terms and conditions shall be governed by and construed in accordance with English law. Any disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English courts.

We do not warrant that any goods or services provided are appropriate or available to use outside of the United Kingdom. If you access this Website from locations outside the United Kingdom, you do so at your own risk and you are responsible for compliance with laws outside of the United Kingdom.
